Why You Need a DUI Accident Attorney in Orlando

Drunk driving crashes are not accidents — they're the result of a conscious decision to get behind the wheel while impaired. Florida consistently ranks among the top states for DUI-related fatalities, and Orlando's busy corridors — I-4, International Drive, and the tourist districts — see far too many alcohol-related crashes every year.

DUI accident cases differ from typical car accident claims in one critical way: you may be entitled to punitive damages. Unlike compensatory damages that cover your losses, punitive damages are designed to punish the drunk driver and deter others. In Florida, there is no statutory cap on punitive damages in most cases, and juries have awarded millions in DUI accident trials.

At ANT Law Firm, our Orlando DUI accident attorneys coordinate with law enforcement, obtain BAC test results and toxicology reports, investigate whether a bar or restaurant overserved the driver, and build a case designed to maximize your total recovery — including punitive damages.

Punitive damages pursued in every eligible case
BAC results and toxicology reports obtained
Criminal case evidence leveraged for civil claim
Dram shop liability investigated
Insurance company lowball tactics defeated
Maximum compensation for catastrophic injuries
Step-by-Step Guide

What to Do After Being Hit by a Drunk Driver

If you suspect the driver who hit you was intoxicated, these steps are critical for building a strong case — both criminal and civil.

1

Call 911 Immediately

Tell the dispatcher you suspect the other driver is impaired. Police will administer field sobriety tests and a breathalyzer. The BAC results become critical evidence.

2

Stay at the Scene & Stay Safe

Move to a safe area if possible. Do not confront the impaired driver. Wait for police to arrive and secure the scene.

3

Document Everything

Photograph the scene, vehicle damage, the other driver's condition, any open containers or bottles, and your injuries. Video is even better.

4

Get Witness Information

Other witnesses may have seen the driver swerving, smelled alcohol, or observed erratic behavior before the crash. Their testimony strengthens your case.

5

Seek Medical Attention

DUI crashes often cause severe injuries due to the high speeds and reckless driving involved. Get a full medical evaluation even if you feel okay initially.

Our Process

How Our DUI Accident Attorneys Build Your Case

DUI accident claims require aggressive investigation and specialized legal strategy. Here's how ANT Law Firm maximizes your recovery.

01

Free Case Review

Call us or submit our online form. We evaluate your DUI accident case within 24 hours — no cost, no obligation.

02

Evidence Collection

We obtain the police report, BAC test results, dashcam/body cam footage, toxicology reports, and any criminal case records against the impaired driver.

03

Medical Documentation

We work with your medical team to document every injury and calculate current and future care costs — DUI crashes often cause catastrophic injuries.

04

Demand & Negotiation

We send a comprehensive demand including punitive damage claims. Insurance companies know DUI cases are indefensible — we leverage that aggressively.

05

Litigation & Trial

If a fair settlement isn't offered, we take the case to trial. Juries have little sympathy for drunk drivers, and verdicts often exceed settlement offers.

Florida Law

Florida DUI Laws & Punitive Damages

In Florida, it's illegal to operate a vehicle with a blood alcohol concentration (BAC) of 0.08% or higher (0.02% for drivers under 21). But even a BAC below the legal limit can support a DUI accident claim if the driver's impairment contributed to the crash.

The key advantage in DUI accident cases is the availability of punitive damages under Florida Statute § 768.72. Driving drunk is considered gross negligence, which opens the door to additional damages beyond your medical bills, lost wages, and pain and suffering. Florida does not cap punitive damages in most personal injury cases.

Additionally, Florida's dram shop law (§ 768.125) may allow you to pursue the bar, restaurant, or social host that served alcohol to the impaired driver — particularly if the driver was a minor or a known habitual alcoholic.

Punitive Damages in DUI Cases

Under Florida law, punitive damages can be three times your compensatory damages or $500,000 — whichever is greater. In cases of intentional misconduct, there is no cap at all. Our Orlando DUI accident attorneys have experience pursuing punitive damage claims and will fight for the maximum award.
